Liability Waiver and Release of Claims

In consideration of being permitted to participate in classes, workshops, demonstrations, or events provided by DAM Defense LLC (hereinafter “the Company”), I acknowledge, understand, and agree to the following:

  1. Voluntary Participation I understand that my participation in any class, seminar, or related event offered by DAM Defense LLC (the “Company”) is completely voluntary and that I may withdraw at any time.

  2. Assumption of Risk I acknowledge that the activities provided by the Company carry inherent risks. I voluntarily assume full responsibility for any risks associated with participation, including but not limited to:

    • General Risks: Physical injury, emotional stress, or harm resulting from misunderstanding or misapplication of information.

    • Firearms (Basic Pistol): Loud noise, muzzle blast, lead exposure, and the risk of serious bodily injury or death from the discharge of a firearm.

    • Medical/Tactical (Stop the Bleed/AVIRT): I consent to the physical application of training aids, including tourniquets and pressure dressings, on my person by instructors or other students. I acknowledge these may cause temporary discomfort or minor bruising.

  3. Equipment & Safety Protocols

    • Equipment Clause: I assume all liability for the condition and operation of any personal firearms or equipment I bring to the course.

    • Safety Rule Violation: I understand that I may be removed from the class immediately, without refund, for any violation of safety protocols or erratic behavior.

  4. Release of Liability I hereby release, waive, and forever discharge DAM Defense LLC, its owners, instructors, agents, employees, contractors, and affiliates from any and all liability, claims, or causes of action arising out of or related to any loss, injury, damage or harm that may occur during or after participation in any class or event, including those resulting from ordinary negligence.

  5. No Guarantee of Outcome I understand that classes are educational. The Company does not guarantee any particular outcome, result or protection against harm. I agree that the skills and information provided are to be used responsibly and at my own discretion.

  6. Medical Acknowledgment & Indemnification I affirm that I am physically and mentally capable of participating in the class or event. I agree to notify the instructor of any condition that may affect my ability to participate safely. I assume all responsibility for my own medical needs. I agree to indemnify and hold harmless DAM Defense LLC from any and all claims, including attorney’s fees, arising out of my participation or actions.

  7. Binding Agreement & Severability This waiver shall be binding upon me, my heirs, executors, and assigns, and shall be governed by the laws of the State of Kansas. If any part of this agreement is found to be unenforceable, the remainder shall remain in full force and effect.

Safety Protocols and Code of Conduct

1. Universal Firearms Safety (Pistol Classes Only) I agree to adhere to the four cardinal rules of gun safety at all times:

• Treat all firearms as if they are loaded.

• Point the muzzle in a safe direction at all times and never at anything I am not willing to destroy.

• Keep my finger off the trigger and on the frame until my sights are on target and I have made the decision to shoot.

• Be sure of my target and what is in its foreground and background.

2. Range Command Compliance I agree to follow all instructions from the Range Safety Officer (RSO) or Instructor immediately and without question. This includes the “CEASE FIRE” or “STOP” command, which I understand can be called by anyone who spots a safety hazard.

3. “Cold” Classroom Policy For AVIRT, Stop the Bleed, and non-live-fire portions of training, I understand no live ammunition is permitted in the training area. I agree to a safety check of my person and gear if requested by the Instructor.

4. Physical Contact & Medical Training I understand that AVIRT and Stop the Bleed classes involve physical movement and the application of medical gear (tourniquets/bandages). I consent to such contact and agree to alert the instructor immediately if I experience pain or discomfort beyond the scope of the drill.

5. Personal Protective Equipment (PPE) I agree to wear appropriate eye and ear protection at all times while on a live-fire range or during designated force-on-force drills. I assume all risks associated with the failure to use or the improper use of PPE.

6. Equipment Clause I assume all liability for the condition and operation of any personal firearms or equipment I bring to the course.

7. Right to Terminate Training I acknowledge that DAM Defense LLC reserves the right to remove me from the training environment—without refund—if I display unsafe behavior, fail to follow commands, or appear to be under the influence of any substance (including prescription medication) that impairs my judgment or motor skills.
